GENERAL TERMS AND CONDITIONS OF RENTAL (FOR INDIVIDUALS)

These General Terms and Conditions of Rental (the “Agreement”) apply to any rental transaction entered into by an individual acting for personal purposes, or the Medical Professional authorised to order product on their behalf, (the “Client”) via the website www.gameready.co.uk (the “Website”).
The Website is operated by GAME READY Rental Ltd, a company incorporated under the law of England, with registered number 08013402, with its registered office at Unit J2, Ascot Business Park Ascot, Berkshire SL5 9FE (UK) (the “Company”).
By placing an order on the Website, the Client acknowledges having read and accepted these Terms in full, without reservation.
1. ACCEPTANCE AND SCOPE
1.1 Acceptance
The Client confirms that it is not possible to place an Order on the Website without first reading and accepting these Terms. Acceptance is confirmed electronically by ticking the relevant checkbox prior to placing the Order.
These Terms may be updated from time to time. The version applicable is the one displayed on the Website at the time of the Client’s Order.
All Orders are personal to the Client (intuitu personae) and may not be assigned or transferred without the Company’s prior written consent.
1.2 Purpose
These Terms define the respective rights and obligations of the Client and the Company in relation to the rental of equipment (the “Equipment”). Nothing in this Agreement creates any employment, agency, partnership, or joint venture relationship.
2. ORDERS
2.1 Equipment Information
The essential characteristics of the Equipment are described on the Website. Photographs are for illustrative purposes only; the delivered Equipment may vary slightly.
For any questions regarding the Equipment, the Client may contact the Company’s customer service at ukrental@gameready.com.
2.2 Placing Orders
2.2.1 Order Process
The Client places an Order through the Website by completing the online rental form, providing accurate personal information. The Client warrants that they are of legal age and have full capacity to enter into this Agreement.
Orders are only confirmed once full payment has been received and the Company provides express confirmation.
The Client must select the package, accessories and delivery method of their choice on the website. The Client confirms the order and makes payment.
2.2.2 Cancellation / Right of Withdrawal
The Client has a right to cancel the Order within seven (7) calendar days of confirmation, without providing reasons and without incurring penalties, unless the Equipment has already been collected with the Client’s consent.
Notification of cancellation must be sent to ukrental@gameready.com.
2.2.3 Rental Duration
The rental period shall be as indicated in the Order confirmation.
The period of hire commences from the date of delivery.
3. PRICE AND PAYMENT
3.1 Pricing
The price payable is the price displayed on the Website at the time of Order, inclusive of VAT and any applicable delivery or handling charges.
3.2 Payment
Payment is due in full at the time of Order and must be made via credit card through the secure payment gateway provided on the Website.
The Client represents and warrants that they are authorized to use the card provided and accepts the terms and conditions of the payment provider.
4. COMPLIANCE OF THE EQUIPMENT
The Company shall provide the Client with Equipment that complies with current regulations, together with the accessories necessary for its use and a user manual.
The Client confirms that they have been fully informed regarding the choice and options of the Equipment, as well as its suitability for their needs. Whilst the Company is subject to a duty to provide information and advice, this is carried out in response to the Client’s enquiries. The Client remains fully responsible for ensuring that the selected Equipment is suitable for their needs.
5. DELIVERY, EXTENSION AND RETURN
All Equipment shall be delivered and collected using the Company’s specified courier. The Company reserves the right to charge the Client for any special delivery arrangements (Saturday delivery £20) or missed collection (£20) if the equipment is not available collection.
Delivery
Delivery occurs only after full payment. Equipment is for use within mainland UK only.
The Company shall not be liable for any delay in delivery.
The Client must inspect the Equipment on receipt and report any visible damage or defects within 48 hours.
In the event delivery is delayed from the date specified on the order, the period of hire will be adjusted accordingly as will the date of collection of the hired products.
No refund for early return will be made.
Extension
In the event the Client wished to extend the rental period, notification of this must be made to the Company and confirmed in writing no less than 48 hours prior to the specified collection date.
Return
The Client shall return the Equipment in good working order, subject to reasonable wear and tear.
The Client must contact the Company at ukrental@gameready.com at least 48hrs prior to the specified collection date to confirm the collection address and to allow sufficient time for the Company to book a courier collection. If the Client fails to contact the Company as above to confirm the equipment is available for collection on the specified collection date (as per the instructions within the information pack) a late return charge of £50 will be applied if the Equipment can Ie collected or returned within 48 hours of the specified collection date.
If after 48 hours of the specified collection date the Equipment have not been collected or returned to the Company, an ongoing fee of £150 will Ie charged for any period up to 14 days from the specified collection date.
6. CLIENT OBLIGATIONS
The Client undertakes to:
Use the Equipment in accordance with its intended purpose and the provided user manual;
Maintain the Equipment and accessories in good condition;
Notify the Company immediately of any fault, defect, or incident;
Refrain from any repair, modification, or substitution of the Equipment;
Ensure the Equipment is insured against theft or loss;
Pay the rental fee on time;
Return the Equipment in good working order at the end of the rental period.
The Client bears all risk associated with the Equipment from delivery until return.
Any information given by the Company relating to the clinical application of the rented Game Ready products is in no way to be construed as a substitute for professional medical advice. The Company advises all Clients to consult with a registered medical professional regarding the suitability, correct application and use of the product prior to using the product
7. COMPANY OBLIGATIONS
The Company shall:
Provide Equipment that complies with applicable regulations, together with necessary accessories and the user manual;
Be entitled to replace or modify the Equipment during the rental period if required for technical, regulatory, or operational reasons.
8. TECHNICAL SUPPORT
Support is available via email (ukrental@gameready.com) or telephone 0845 2417920.
Repairs caused by misuse, negligence, or improper handling by the Client are excluded from warranty. The Company is solely responsible for repairing or replacing Equipment under warranty.
9. RISK OF LOSS OR DAMAGE
Risk of loss or damage will be the responsibility of the Client from the time of delivery until collected by ParcelForce for return to the Company. The Client undertakes to fully insure all products for the rental period for replacement retail value. The Client is responsible for any and all damages and repair costs that may arise from the misuse of the product during the rental period. If returned equipment is damaged due to being incorrectly repackaged or labelled as per the instructions, the Company will notify the Client in writing and it will be the Client’s responsibility to pay full repair costs of the equipment. If the equipment cannot be repaired, the Client will be responsible for the retail replacement cost of the equipment damaged or missing.
10. WARRANTY AND LIABILITY
In no event will the Company be liable to the Client for any incident or injury, indirect or consequential damages caused by negligent or incorrect use of the equipment. The Client assumes sole responsibility for the choice, use, and suitability of the Equipment.
11. OWNERSHIP
The Equipment remains the sole property of the Company. No transfer of ownership occurs under this Agreement.
12. DATA PROTECTION
Personal data is collected and processed in accordance with UK data protection laws for order fulfilment, customer support, and marketing purposes.
The Client has the right to access, correct, and request deletion of their personal data.
13. INTELLECTUAL PROPERTY
All Website content, including text, images, and technology, is the property of the Company and protected under copyright, trademark, and patent law.
14. INDEMNITY
The Client agrees to indemnify and hold harmless the Company from and against all claims, damages and costs including legal expenses arising out of the Client’s improper use of the equipment. The Client agrees to take full responsibility for the proper use and care of the equipment during the rental period so that it is returned in the same condition as when received.
15. FORCE MAJEURE
Neither Party shall be liable for delays or non-performance due to events beyond their reasonable control, including pandemics, natural disasters, governmental restrictions, network failures, or similar events.
If the force majeure event exceeds fifteen (15) days, either Party may terminate the Agreement.
16. SEVERABILITY
If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of England.
Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
